Terms and Conditions

These Terms govern your access to and use of the Adspire d.o.o. – Moj Salon platform (“Service”).

By creating an account, subscribing, or using the Service, you agree to these Terms.

2. Eligibility

You represent that:

• You are at least 18 years old

• You act on behalf of a business or legal entity

• You have authority to bind that entity

3. Service Description

We provide a cloud-based marketing optimization and automation platform.

We may modify or update the Service at any time to improve functionality.

4. Accounts

You are responsible for:

• Maintaining account security

• All activity under your account

Notify us immediately of unauthorized use.

5. Subscriptions and Payments

Payments are processed by Lemon Squeezy, Inc. as Merchant of Record.

Subscriptions:

• Renew automatically

• Can be canceled anytime before renewal

All fees are non-refundable unless required by law.

6. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable license to use the Service.

You agree not to:

• Use the Service unlawfully or for deceptive marketing

• Upload or process illegal or infringing content

• Interfere with system integrity or security

• Reverse-engineer or copy the Service

• Resell or misuse accounts

7. Customer Data and Data Processing

You retain ownership of all data submitted to the Service.

Where we process personal data on your behalf, we act as a data processor under the GDPR.

Such processing is governed by our Data Processing Agreement (DPA), which forms part of these Terms.

8. Intellectual Property

All rights in the Service remain our exclusive property.

You grant us a limited license to use your data solely to provide and improve the Service.

If you provide feedback, you grant us a perpetual, royalty-free right to use it without restriction.

9. Service Availability

The Service is provided on an “as available” basis.

We do not guarantee uninterrupted or error-free operation.

We may suspend the Service for maintenance, security, or technical reasons.

10. Third-Party Services

The Service may include third-party integrations.

We are not responsible for third-party services, which are governed by their own terms.

11. Termination

You may cancel your subscription at any time.

We may suspend or terminate your access if you violate these Terms.

Upon termination:

• Your access will end

• We may delete your data after a reasonable retention period unless legally required otherwise

12. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect or consequential damages

• Our total liability is limited to fees paid in the previous 12 months

Nothing excludes liability where prohibited by law (e.g., fraud, willful misconduct).

13. Indemnification

You agree to indemnify and hold harmless Adspire d.o.o. from any claims arising from:

• Your use of the Service

• Your data or content

• Your violation of these Terms or applicable law

14. Force Majeure

We are not liable for delays or failure due to events beyond our reasonable control, including outages, cyber incidents, or infrastructure failures.

15. Governing Law

These Terms are governed by the laws of Slovenia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Slovenia.

16. Changes to Terms

We may update these Terms from time to time.

We will provide reasonable notice of material changes. Continued use of the Service after such changes constitutes acceptance.
